Tax-Free Real Estate Investment: How CONFOTUR Makes the Dominican Republic Unique

The Dominican Republic is one of the few places where the phrase “tax-free real estate” is close to accurate, and the reason is a single piece of legislation: CONFOTUR. For an investor, it can mean no transfer tax at closing, no annual property tax for years, and no Dominican income tax on the rent the property earns. But “tax-free” is a phrase that rewards precision, and the details, what is exempt, for how long, who qualifies, and what is not covered, are where a sound decision is made. This guide sets them out.

What Is CONFOTUR?
CONFOTUR stands for Consejo de Fomento Turístico, the Tourism Development Council. It is the framework established by Law 158-01 in 2001, and extended by Law 195-13 in 2013, to attract investment into the country's tourism infrastructure. The government grants tax incentives to developers who build qualifying projects in designated tourism zones, and, crucially for the buyer, those incentives pass through to the individual who purchases a unit in an approved development.
The benefit, therefore, is not a feature of the Dominican Republic in general. It attaches to specific, certified projects. That single distinction is the source of most of the confusion that surrounds the program, and it is where this guide spends the most time.
The CONFOTUR Exemptions, Exactly
In an approved project, a buyer can benefit from four exemptions:
The 3% property transfer tax. Normally payable when the title is registered in your name. On a $200,000 property, the exemption saves $6,000 at closing.
The 1% annual property tax (IPI), for up to 15 years. IPI normally applies at 1% on the value of an individual's holdings above a threshold of roughly $166,000. The exemption removes it for the duration set by the project's resolution.
Income tax on rental earnings, for up to 10 years. Rental income from a qualifying project can be exempt from Dominican income tax during this period, which directly improves the net yield of a rental investment.
Import duties on furnishings and equipment. Granted to the developer, this often reaches buyers as a high-quality furniture package at favorable prices.
The combined effect on return is the reason CONFOTUR matters so much in practice. What “Tax-Free” Does Not Mean
A precise reading of CONFOTUR is more useful than an enthusiastic one, and there are four limits worth understanding before you rely on the benefit:
It does not cover every new build. Only officially certified projects qualify. Certification is a rigorous, project-specific process resulting in a formal resolution; a new development is not automatically eligible simply because it is new.
It does not erase your home-country taxes. CONFOTUR exempts Dominican taxes. U.S. and Canadian investors are taxed on worldwide income and must still report. Double-taxation treaties with Canada and Spain can prevent being taxed twice, but the obligation to declare remains.
It is time-limited. The exemptions last up to 15 years for property tax and up to 10 for rental income. After the term, the property enters the standard Dominican tax structure.
Its treatment on resale varies. The transfer-tax exemption applies to the qualifying purchase; whether a future buyer inherits the remaining property-tax exemption depends on the project, and should be confirmed rather than assumed.
None of these limits diminishes the value of CONFOTUR. They simply define it. An investor who understands exactly what is exempt, and for how long, is in a far stronger position than one relying on the headline phrase.
How to Verify That a Project Actually Qualifies
Because the benefit is project-specific, due diligence is straightforward but essential. Before committing, take these steps:
Ask the CONFOTUR question first. Before viewing or reserving, ask whether the project holds a current and active CONFOTUR resolution, not one that is merely pending.
Obtain the resolution in writing. Request a copy of the Resolución issued by the Ministry of Tourism, and have your independent attorney confirm it is valid and current.
Check the purchase agreement. Ensure it includes a clause obliging the developer to maintain CONFOTUR status through to the transfer of title.
File the exemption correctly. Claiming the benefit requires a declaration to the Dominican tax authority (DGII); your attorney handles this as part of the closing.
Why This Makes The Dominican Republic Unique
Tax incentives for foreign property buyers exist elsewhere, but the combination CONFOTUR offers is difficult to match: a transfer-tax waiver, well over a decade without property tax, and rental income free of local tax, all available to non-residents on the same terms as citizens.
