CONFOTUR 2026: how to verify a development before investing

Purchasing a property in the Dominican Republic can be an excellent decision for those seeking a second residence, an institutional asset, or a unit with vacation rental potential. Within this process, one of the concepts generating the most interest among local and international buyers is CONFOTUR.

Many real estate developments promote their tax benefits as a major incentive for buyers. Indeed, when a development is correctly registered under CONFOTUR, the advantages can be highly significant. However, there is one crucial point to consider: it is not enough for a development's marketing collateral to state that it has CONFOTUR status. Before proceeding with a purchase, verification is highly recommended.

What is CONFOTUR?

CONFOTUR is the Tourism Promotion Council, the body responsible for applying Law 158-01 on tourist development promotion in the Dominican Republic. This legislation was established to stimulate tourism developments in high-growth areas, encouraging new investments, employment, infrastructure, and overall economic development.

Within the real estate market, CONFOTUR has become a highly valued factor, particularly in destinations such as Punta Cana, Cap Cana, Bávaro, Samaná, Miches, and other established resort areas. For many buyers, acquiring a property within a development registered under this law can represent a significant difference in the costs associated with property purchase and ownership.

Among the most widely recognized benefits are potential exemptions related to the real estate transfer tax and the Real Estate Property Tax, known as IPI. Nonetheless, each case must be analyzed in detail, as benefits depend on the development itself, its current status, the specific unit acquired, and the applicable regulations at the time of purchase.

Why you should not assume a development has CONFOTUR

One of the most common oversights when purchasing prime property in the Dominican Republic is assuming that a development benefits from CONFOTUR simply because it is mentioned in a presentation, a commercial website, or during a sales discussion.

A development may be approved, in the application process, in the provisional classification stage, or awaiting final documentation. These scenarios are distinct and do not offer the same level of certainty for the investor.

Consequently, before placing a reservation deposit, signing a promise of sale agreement, or committing to a payment structure, it is advisable to request official documentation. 

Provisional vs. Definitive Classification

When evaluating a development, it is essential to understand the difference between provisional classification and definitive classification.

Provisional classification indicates that the development has undergone an initial evaluation and meets certain requirements to proceed. While a positive indicator, it does not always guarantee that the development has completed all necessary phases to provide the buyer with the highest level of legal security.

Definitve classification, on the other hand, offers greater peace of mind, confirming that the development has met the required criteria and has received formal approval within the CONFOTUR framework.

This does not mean developments with provisional classification should be dismissed. Many developments are marketed in their early stages and present excellent investment opportunities. However, the buyer must be fully aware of the status of the development, the remaining requirements, and the implications should the process experience delays.

Documents to request before buying

Prior to committing to a property promoted with CONFOTUR benefits, it is prudent to request documentation to verify the status of the development.

Key documents include the formal CONFOTUR resolution or certification, the legal name of the development, the file or application number, the developer’s corporate name, the description of the approved development, and, where applicable, confirmation that the specific unit being purchased is included within the classified development.

It is also advisable to review additional documentation essential to any real estate transaction, irrespective of CONFOTUR status. This includes the legal status of the land, construction permits, environmental approvals, urban planning licenses, approved architectural plans, finishes specifications, the promise of sale contract, the payment schedule, and terms of delivery.

While CONFOTUR presents an attractive incentive, it does not replace a comprehensive legal review. A development may offer tax advantages and still require rigorous due diligence regarding delivery timelines, permits, warranties, future property management, and contractual terms.

Key dates to verify

Timelines and dates are among the most critical aspects when verifying CONFOTUR status.

It is not enough to know that a development is registered. One must also ascertain the date from which the benefits apply, the remaining duration of the exemption, and the implications if property delivery is delayed beyond the projected date.

For off-plan acquisitions, reviewing the construction and delivery schedule is particularly vital. When purchasing pre-sale units, buyers must clearly understand which portion of the benefit is confirmed and which portion depends on future approvals or construction milestones.

Quick checklist before signing

Before purchasing a property marketed with CONFOTUR benefits, consider reviewing the following:

  • Official name of the development.

  • Name of the developer.

  • Type of classification: provisional or definitive.

  • Resolution, file, or certification number.

  • Tax benefits applicable to the buyer.

  • Confirmation that the specific unit is included.

  • Commencement date of the exemption period.

  • Estimated duration of the tax benefits.

  • Legal status of the land.

  • Relevant permits, licenses, and authorizations.

  • Purchase agreement and delivery conditions.

  • Review by an independent legal or tax advisor.
